A private ruling from the commissioner General of TRA. The ruling is binding on the TRA and sets forth the applicability of statutory provisions of any ax or charge administered to a specific set of facts. The Transfer Pricing Regulations 2014 issued in May 2014 provides guidelines on transfer pricing. It is a requirement that a Transfer Pricing Policy should be documented before filing a final return for that year. The Transfer Pricing Policy shall be submitted to the Commissioner within thirty days. Otherwise, there is a penalty for failure to comply with the documentation requirements. The regulations apply to related parties engaged in intra-company, cross border and domestic transactions. Financing arrangement may indicate existence of a transfer pricing arrangement. The Commissioner General has power to adjust transaction prices where he is of the view that the related parties did not transact at arm’s length..
